This Privacy Policy ("Policy") governs your use of the Jet Wars mobile application ("App," "Game," "Service"), developed and published by BESTAPPS LLC ("we," "us," "our," "Company," "Developer"). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy in its entirety. If you do not agree to this Policy, you must immediately cease all use of the App and delete it from your device.
0. WHICH VERSION OF THE APP YOU ARE USING
This Policy covers two different builds of the App, and the difference matters, so we state it at the top rather than burying it.
Versions 1.2 and earlier contain no advertising of any kind. No ad network, no ad SDK, no advertising identifier, no third-party code whatsoever. If you are running one of these versions, §2 (Advertising) does not apply to you, and the App collects nothing about you at all.
From version 1.3 onward, the App shows optional, opt-in rewarded advertisements supplied by Google AdMob, as described in §2. This introduces the first third-party code ever included in the App and the first collection of data about your device — collected by Google, not by us. Nothing else in the App's privacy posture changes: we still run no accounts, no player database, and no back end, and we still receive no personal data about you.
You can check which version you are running in iOS Settings → General → iPhone Storage → Jet Wars, or on the App's title screen.
1. INFORMATION WE COLLECT
1.1 Personal Data
We do not collect, store, transmit, share, sell, rent, lease, or otherwise process any personal data or personally identifiable information (PII). We run no accounts and no game back end of any kind. We operate a website, whose only involvement with the App is serving one small public file that says which app version is current (§1.3(d)); it holds no user data and asks the App for nothing.
This remains true in version 1.3. What changes in 1.3 is that a third party — Google — collects data about your device through the advertising component running inside the App. That data goes to Google under Google's own privacy policy and is not passed to us in any individually identifiable form. See §2 in full.
Specifically, we do not collect:
- Names, email addresses, phone numbers, or mailing addresses
- Location data (GPS or precise geolocation)
- Biometric data, facial recognition data, or voiceprints
- Payment card numbers, bank details, or billing addresses
- Health, fitness, or medical data
- Contacts, calendars, photos, or other device-stored personal content
- Browsing history or search history
- Social media accounts, login credentials, or authentication tokens
Three things are worth stating plainly rather than leaving to inference:
Purchases. The App offers in-app purchases (see §5). These are processed entirely by Apple. We never see, receive, or store your payment card details, billing address, or Apple ID. What reaches the App is a signed StoreKit transaction confirming that a purchase completed.
Your callsign. If you choose to play LAN multiplayer, the App transmits a callsign you type yourself, along with your profile icon and in-game statistics, to the other players on your local network (see §1.3(b) and §6.4). It is never sent to us. You choose what to type, and we recommend not using your real name.
Advertising (version 1.3 and later). If you choose to watch a rewarded advertisement, Google's advertising component collects device and ad-interaction data in order to select, deliver, and measure that advertisement. This includes your IP address and, if you permit it, your device's advertising identifier. This data is collected by Google, is governed by Google's privacy policy, and reaches us only as anonymous aggregate revenue and performance totals that name nobody. §2 sets out exactly what is collected and how to limit or refuse it.
1.2 Locally Stored Game Data
The App stores game data exclusively on your device using Apple's standard UserDefaults storage mechanism. This data includes:
- In-game currency balances (gold, gems, and oil), including gems added by a purchase or earned by watching a rewarded advertisement
- Which in-app purchases have been delivered, recorded so a purchase is never credited twice
- Unlocked aircraft and equipment, equipped loadouts and upgrade levels
- Player level, experience points, high scores, and mission progress
- A callsign and profile icon you choose, used for multiplayer
- Multiplayer career statistics and a local record of opponents previously faced
- Game settings (such as audio and HUD preferences)
- Tutorial completion status
- Which special offers you have been shown and which you dismissed, how many sessions you have played, and when you last made a purchase — used solely so the App can decide what to show you and, more often, when to stay quiet
- Which of two artwork treatments for the same offer your device was assigned (see §5)
- Your Daily Vault entitlement, your daily-gift streak, and when you last claimed it
- The highest clock reading this installation has seen, which stops in-game timers being cheated by changing the device clock
- Which app version you were last prompted to update to
- From version 1.3: how many rewarded advertisements you have watched today and when you last watched one, so the App can cap them; and your recorded advertising consent or refusal, so you are not asked repeatedly
This data is not transmitted to us or to any server we operate. It exists in your device's local storage. Deleting the App will permanently erase all locally stored game data. The exceptions are the subset of data shared directly with other players during a LAN match (§1.3(b)) and the data handled by Google's advertising component (§2).
1.3 Network Use
Setting aside advertising, which is described separately in §2, the App makes network use in exactly four ways. Three involve no server of ours at all; the fourth reads a single public file from our website and sends nothing about you:
(a) Connectivity check. The App uses Apple's Network framework to detect whether your device has an active internet connection. No data is transmitted. The result is used only to decide whether certain end-of-game rewards are granted.
(b) LAN multiplayer. When — and only when — you open the multiplayer mode, the App advertises and browses for a Bonjour service (_jetwars._tcp) on your local network and opens direct TCP connections to other devices running the App on that same network. This requires iOS local-network permission, which you may grant or refuse; refusing it disables multiplayer and affects nothing else. Over that connection the App exchanges:
- the callsign and profile icon you chose
- your selected aircraft, level, and whether you have certain equipment fitted
- your multiplayer career statistics (matches, kills, win rate)
- live match data: aircraft position, heading, speed, health, and weapons fire
This traffic goes directly between devices on your local network. It does not traverse the internet, is not routed through any server, and is never received by us.
(c) Purchases. In-app purchases are transacted between your device and Apple using Apple's StoreKit framework. We are not a party to that connection and receive no data from it beyond the signed confirmation that a purchase succeeded.
(d) Update check. Once per launch the App makes one HTTPS GET request to https://jetwars.xyz/version.json, a small static file that says which app version is current. The request carries no query string, no body, no identifier and nothing about you or your game — it is the same request any web browser would make for a public file. As with any internet connection, the host serving it (Cloudflare, our website host) necessarily receives the IP address the reply must be sent to, along with the timestamp and a standard user-agent string. We do not enable request logging on that host, do not export or retain such logs, and do not analyse them. The response is used only to decide whether to show you an "update available" prompt. If the request fails, the App carries on silently.
(e) Advertising — version 1.3 and later only. The advertising component connects to Google's ad servers to request, deliver, and measure advertisements, and to Apple's SKAdNetwork for privacy-preserving attribution. This is described in full in §2.
Beyond these, the App makes no HTTP requests, API calls, or WebSocket connections to any server, endpoint, or external service.
2. ADVERTISING (VERSION 1.3 AND LATER)
This section does not apply to versions 1.2 and earlier, which contain no advertising and no advertising code.
2.1 What the advertising is, and how little of it there is
From version 1.3, the App offers rewarded video advertisements. These are:
- Opt-in, every single time. An advertisement never interrupts you, never plays automatically, and never appears between missions or over the menus. It plays only after you tap a clearly labelled button offering an in-game reward in exchange for watching one. Declining costs you nothing but the reward.
- Never required to progress. Every aircraft, weapon, and upgrade remains obtainable by playing the game or by purchase. Advertisements are an optional third route, never the only route, and no mission, chapter, or item is gated behind watching one.
- Capped. The App limits how many rewarded advertisements you can watch in a day.
- Not banners or interstitials. The App displays no banner advertisements, no full-screen advertisements you did not ask for, no advertisements on the menus, and no advertisements during gameplay.
We do not sell advertising space directly, do not choose which advertisements you see, and have no relationship with the advertisers whose creatives appear.
2.2 Who supplies the advertising
Advertisements are supplied by Google AdMob, a service of Google LLC (and, for users in the European Economic Area, the United Kingdom, and Switzerland, Google Ireland Limited). Google acts as an independent controller of the data it collects through AdMob.

Should we add additional advertising or mediation partners in future, we will name them in this Policy and update it before that version of the App ships.
2.3 What data the advertising component collects
When you watch a rewarded advertisement — and, where technically necessary to prepare one, when the App loads an advertisement you have opted into — Google's advertising component may collect and process:
- IP address, from which an approximate location (typically country, region, or city level) may be derived. Precise GPS location is never accessed; the App does not request location permission at all.
- Advertising identifier, being Apple's Identifier for Advertisers (IDFA) only if you grant permission through the App Tracking Transparency prompt described in §2.5, and, separately, an app-scoped or vendor identifier used for frequency capping and fraud prevention.
- Device and technical information: device model, operating system version, screen dimensions, language, time zone, carrier, network type, and available memory.
- Advertisement interaction data: which advertisements were requested, shown, viewed to completion, skipped, clicked, or converted, and the timestamps of those events.
- App information: the App's identifier and version, and whether the advertisement was served in a rewarded placement.
- Diagnostic data relating to advertisement delivery, such as load failures and latency.
Google uses this data to select and deliver advertisements, to cap how often you see the same one, to detect invalid traffic and fraud, to measure advertisement performance, and — where you have consented and where permitted by law — to personalise advertisements based on inferred interests. Google's retention periods and full processing purposes are set out in Google's own privacy policy, linked above.
2.4 What we receive
We receive aggregate, anonymous reporting only: totals such as how many advertisements were requested and watched, completion rates, and revenue earned, broken down by country and by placement. These totals name nobody, identify no device, and cannot be linked by us to any individual player, Apple ID, or installation. We have no access to Google's underlying event-level data and no ability to look up any individual person.
We do not receive, buy, or build any profile of you, and we do not combine advertising data with your game data — which in any case never leaves your device.
2.5 App Tracking Transparency, and what happens if you decline
Because personalised advertising can involve tracking as Apple defines it, the App presents Apple's App Tracking Transparency prompt before any advertising identifier is used for that purpose.
- If you decline (or have "Allow Apps to Request to Track" switched off in iOS Settings), the App does not access your IDFA, and Google is instructed to serve non-personalised advertisements. You will still be able to watch rewarded advertisements and receive the reward. Non-personalised advertisements are selected using contextual signals — such as your approximate country and the fact that this is a flight-combat game — rather than your interests or past behaviour. Google still processes a limited amount of data for frequency capping, fraud prevention, aggregate measurement, and legal compliance.
- If you accept, Google may use your IDFA to personalise advertisements and measure their effectiveness.
You may change this at any time in iOS Settings → Privacy & Security → Tracking. Declining tracking never reduces your rewards, never reduces what the game offers you, and never changes the price of anything.
2.6 Consent in the EEA, the United Kingdom, and Switzerland
If you are in the European Economic Area, the United Kingdom, or Switzerland, the App presents a separate consent message, provided through Google's User Messaging Platform, before any non-essential advertising data is processed. You may consent to personalised advertising, refuse it, or manage individual purposes and vendors. Refusing means you see non-personalised advertisements instead; the reward is identical either way.
You can reopen that consent form at any time from the App's Settings → Privacy screen and change or withdraw your choice. Withdrawing consent does not affect the lawfulness of processing carried out before you withdrew it.
Where we rely on a lawful basis for processing, it is your consent for personalised advertising, and our legitimate interest in funding the App's continued development for the limited processing necessary to deliver a non-personalised advertisement, cap its frequency, and prevent fraud.
2.7 Apple SKAdNetwork
From version 1.3, the App participates in SKAdNetwork, Apple's privacy-preserving advertisement attribution framework. SKAdNetwork reports install and conversion events to advertising networks in an aggregated, delayed form designed by Apple so that individual users cannot be identified. It operates at the level of Apple's own systems, requires no identifier, and functions whether or not you accept tracking.
2.8 Turning advertising off entirely
Rewarded advertisements are opt-in by design: if you never tap a button that offers a reward for watching one, no advertisement is ever requested, and the advertising component never sends anything. That is the complete opt-out, and it requires no setting.
In addition, the App's Settings → Privacy screen lets you disable rewarded advertisements outright, which hides the buttons that offer them.
3. INFORMATION WE DO NOT COLLECT
For the avoidance of any doubt, we explicitly confirm that we do not:
- Transmit to us, or to anyone, any record of your gameplay behavior, progress, or in-game usage patterns
- Use any analytics platforms (including but not limited to Google Analytics, Firebase Analytics, Mixpanel, Amplitude, Flurry, or any equivalent)
- Use any crash reporting services (including but not limited to Crashlytics, Sentry, Bugsnag, or any equivalent)
- Use any attribution, install-tracking, or marketing SDKs beyond the SKAdNetwork participation described in §2.7
- Access the device's camera, microphone, photo library, contacts, calendar, health data, location services, or Bluetooth
- Request or access precise location. The App never presents a location permission prompt
- Operate any user database, player back end, or online accounts, or require registration, sign-in, or an email address of any kind. (We do operate a website, which serves the single public file described in §1.3(d). It holds no user data.)
- Sell your personal information for money
- Engage in cross-app or cross-site tracking on our own behalf, or build any profile of you
In versions 1.2 and earlier we additionally used no advertising network, displayed no advertisements, used no advertising identifier, and used neither App Tracking Transparency nor SKAdNetwork. From version 1.3 those four statements no longer hold, in the specific and limited way §2 describes, and only for players who choose to watch a rewarded advertisement.
The App does keep a few counters on your device — how many sessions you have played, which offers you have already seen and dismissed, when you last purchased, how many rewarded advertisements you have watched today. They exist so the App can decide what to show you, they never leave your device, and deleting the App erases them.
The callsign and profile icon described in §1.1 are a local device setting, not an account. They are stored on your device, are not registered with us, and can be changed or cleared at any time.
4. THIRD-PARTY SERVICES AND SDKS
Versions 1.2 and earlier integrate no third-party software development kits, libraries, frameworks, services, or APIs of any kind beyond Apple's own first-party iOS frameworks — including SwiftUI, UIKit, SceneKit, SpriteKit, AVFoundation, Metal, Foundation, StoreKit, and Network. No third-party code runs inside those builds.
From version 1.3, the App includes exactly one third-party SDK:

There are no analytics providers, no social media integrations, no authentication providers, and no data brokers involved in the operation of the App. One further third-party service is involved outside the App: Cloudflare hosts our website and therefore serves the static update-policy file described in §1.3(d). Payment processing is performed by Apple as part of the App Store, not by a third-party processor we have engaged.
5. IN-APP PURCHASES AND PAYMENTS
The App offers in-app purchases.
The App sells: five consumable packs of "gems," an in-game virtual currency, from $0.99 to $19.99; three bundle packs at $2.99, $4.99 and $19.99 that combine an aircraft, equipment and currency; and one $29.99 permanent purchase, the Quartermaster's Contract, which raises your daily in-game gift for as long as you have the App. Gems can then be spent inside the App on aircraft, weapons, upgrades, cosmetic items, in-game gold, and refills of the "oil" resource that gates mission launches.
The following apply:
- All purchases are optional. Every aircraft, weapon, and upgrade in the App can also be obtained through gameplay using currency earned by playing. Purchases accelerate progress; they do not unlock content that is otherwise unreachable.
- There are no subscriptions and no recurring charges of any kind. The $29.99 Quartermaster's Contract is a single one-off purchase that never renews and is never billed again, even though what it grants arrives daily and is claimed by hand in the store.
- All transactions are processed by Apple through the App Store using StoreKit. We do not operate a payment system, and we do not receive, handle, or store your payment card details, billing address, or Apple ID credentials.
- Gems are a consumable virtual item. They have no monetary value, cannot be exchanged for cash, and are not transferable between devices, accounts, or users.
- Purchased content is stored locally. Because the App has no accounts or cloud save, deleting the App erases your game data, including any gems purchased and not yet spent. Please be aware of this before deleting the App. The one exception: permanent one-off purchases — the beginner bundle and the Quartermaster's Contract — are tied to your Apple ID rather than to this installation, so after a reinstall you can bring them back with Restore Purchases in the App's settings.
- Two artwork treatments. Some offers are shown in one of two artwork styles, assigned at random on your device. The two styles are sold under separate App Store product identifiers at the same price with the same contents, so when a purchase happens, the identifier records which artwork was on screen and Apple's ordinary aggregate sales report tells us which artwork sold better. That is a genuine measurement of purchasing behaviour, and we would rather state it than leave it to inference. It reaches us only as Apple's sales totals: it names nobody, is not linked to any person, device, or Apple ID, and no data about the test ever leaves your device.
- Refunds are handled by Apple under its standard App Store refund policy, at reportaproblem.apple.com. We are not able to issue refunds directly.
- Purchases can be restricted. iOS Screen Time settings allow in-app purchases to be disabled entirely or to require approval — see §6.2.
- Advertising and purchasing are independent. Buying something does not change which advertisements you see, and watching an advertisement does not change what anything costs. There is no "remove ads" purchase, because advertisements are opt-in and can simply be left alone.
6. CHILDREN'S PRIVACY AND YOUNGER PLAYERS
6.1 COPPA and children's data
The App is a general-audience game. It is not directed to children under 13, and we do not knowingly collect, use, or disclose personal information from children under 13 (or the applicable age of digital consent in your jurisdiction). We run no user accounts, no player database and no back end, and we collect no personal information from any user of any age.
Advertising and younger players (version 1.3 and later). Because advertising components can collect device data, the App applies additional protections:
- The App instructs Google, through the flags Google provides for this purpose, to apply child-directed treatment and under-age-of-consent treatment where a user is identified as below the applicable age. In that state Google serves only non-personalised advertisements, does not use the advertising identifier for personalisation, and does not use the data for interest-based profiling or remarketing.
- Users below the applicable age of digital consent are never shown the App Tracking Transparency prompt and their advertising identifier is never requested.
- No advertisement in the App is targeted on the basis of a user's personal characteristics.
If you believe a child under 13 has provided personal information through the App, contact us at the address in §19 and we will delete anything we hold — though in practice we hold nothing, because nothing reaches us.
6.2 In-App Purchases and Parental Controls
Because the App offers in-app purchases, parents and guardians should be aware that a device signed in to an Apple ID with a payment method may be able to make purchases. Apple provides controls for this on the device:
Settings → Screen Time → Content & Privacy Restrictions → iTunes & App Store Purchases → In-app Purchases → Don't Allow
Families using Apple's Family Sharing may also enable Ask to Buy, which requires a parent or guardian to approve each purchase. We encourage parents to use these controls. Refund requests for purchases made by a child are handled by Apple at reportaproblem.apple.com.
6.3 Advertising and parental controls
Rewarded advertisements can be switched off entirely in the App's Settings → Privacy screen, and they never play unless someone taps a button asking for one. Advertisements are supplied by Google and are subject to Google's own family-safe content policies for the ad formats used. Parents who wish to prevent advertisements from being watched at all should disable them in that settings screen.
6.4 LAN Multiplayer and Younger Players
Multiplayer matches are played with other people on the same local Wi-Fi network. Players see one another's chosen callsign and profile icon. There is no chat, no messaging, no voice, no friend list, and no way to contact another player through the App.
Callsigns are filtered for offensive language twice: once when you enter one, and again on the receiving device, so a callsign that evades the first check is replaced with "PILOT" before any other player sees it. A callsign is nonetheless free text visible to others, so we recommend that younger players do not use their real name. A callsign can be changed at any time in the App's settings, and multiplayer can simply not be used.
6.5 Age-Appropriate Content
The App contains stylized military flight gameplay with non-graphic, cartoon-style visual effects. There is no realistic violence, gore, blood, profanity, sexual content, or substance use. The App contains no gambling and no randomized paid rewards ("loot boxes"): every purchase states exactly what it delivers before you buy it, and every rewarded advertisement states exactly what it grants before you watch it.
7. YOUR PRIVACY CHOICES AND CONTROLS
Everything in this section is optional, and none of it reduces what the game gives you.

8. DATA SECURITY
We hold no personal data, so there is no store of personal data of yours that we could lose. Locally stored game data is protected by your device's built-in security features, including device passcode, Face ID, Touch ID, and iOS sandboxing. We do not have access to your device or its contents. Data handled by Google's advertising component is transmitted over encrypted connections and secured under Google's own security programme, which we do not control.
One limitation is worth stating openly: LAN multiplayer traffic is not encrypted. It is sent as plain TCP between devices on your local network, which is the ordinary approach for same-Wi-Fi local play. It carries only the gameplay data listed in §1.3(b) — a callsign, an icon, aircraft statistics, and live positions — and never credentials or payment information. Anyone with the ability to inspect traffic on your local network could in principle observe it. Consider this before playing on a public or untrusted Wi-Fi network.
9. DATA SHARING AND DISCLOSURE
We do not sell your personal information for money, and we do not share, rent, trade, or license your data to data brokers or marketing companies.
Data leaves your device in four ways, and only the fourth is new in version 1.3:
- To Apple, when you make an in-app purchase. Apple's handling of that transaction is governed by Apple's Privacy Policy.
- To other players, when you choose to join or host a LAN multiplayer match, limited to the gameplay data listed in §1.3(b) and only for the duration of the match. At your direction.
- To our website, once per launch, to read the update-policy file described in §1.3(d). This one is automatic rather than at your direction, and it carries only the IP address and user-agent inherent in any web request.
- To Google, when you choose to watch a rewarded advertisement in version 1.3 or later, limited to the data listed in §2.3, and governed by Google's privacy policy. At your direction, and never if you do not opt in.
A note on "sharing" under US state privacy laws. Several US state laws, including the California Privacy Rights Act, define delivering personalised advertising as "sharing" personal information for cross-context behavioural advertising, even where no money changes hands. On that definition, allowing personalised advertisements may constitute sharing. Declining the tracking prompt, or turning rewarded advertisements off, is a complete opt-out and instructs Google to apply restricted data processing. We do not sell personal information for monetary consideration under any definition.
We may also disclose information where required to do so by law, court order, or valid legal process, or to protect our legal rights — noting that we hold essentially nothing that could be disclosed.
10. YOUR RIGHTS
Depending on your jurisdiction, you may have rights regarding personal data, including rights of access, correction, deletion, portability, restriction, objection to processing, and freedom from discrimination for exercising those rights.
As regards data held by us: we hold no personal data about you, so there is nothing for us to access, correct, delete, port, or restrict. We will confirm this in writing on request.
As regards data held by Google through the advertising component in version 1.3 and later: Google is an independent controller of that data, and rights requests concerning it should be directed to Google using the mechanisms in Google's privacy policy at https://policies.google.com/privacy. We will assist where we are able, though our access is limited to anonymous aggregate totals.
You retain full control of the data on your device — see the table in §7. Exercising any of these rights never degrades the game, never reduces your rewards, and never changes any price.
If you are in the EEA or the UK, you also have the right to lodge a complaint with your local supervisory authority.
11. INTERNATIONAL DATA TRANSFERS
We transfer no personal data across any border, because we collect none.
- In-app purchases are processed by Apple, which operates internationally and whose transfers are governed by Apple's own privacy policy.
- LAN multiplayer data does not leave your local network.
- The update check described in §1.3(d) is answered by whichever Cloudflare edge location is nearest you, which may be outside your country; that request contains no personal data beyond the IP address inherent in making any internet connection at all.
- From version 1.3, data collected by Google's advertising component may be processed on servers in the United States and other countries where Google or its sub-processors operate. 12. COMPLIANCE WITH APPLICABLE LAWS
This Policy and the App's data practices are designed to comply with applicable privacy laws and regulations, including but not limited to:

- UK GDPR and the Privacy and Electronic Communications Regulations (United Kingdom)

13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
WE ARE NOT RESPONSIBLE FOR THE CONTENT OF THIRD-PARTY ADVERTISEMENTS, FOR THE PRIVACY PRACTICES OF ADVERTISERS WHOSE CREATIVES APPEAR, OR FOR ANY WEBSITE OR APPLICATION YOU REACH BY TAPPING AN ADVERTISEMENT. THOSE DESTINATIONS ARE GOVERNED BY THEIR OWN PRIVACY POLICIES AND TERMS.
IN NO EVENT SHALL THE DEVELOPER'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF THE APP EXCEED THE AMOUNT YOU PAID TO THE DEVELOPER FOR THE APP AND ITS IN-APP PURCHASES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE US DOLLAR ($1.00), WHICHEVER IS GREATER.
Nothing in this Policy limits any liability that cannot be limited under applicable law, or affects your statutory consumer rights.
14. INDEMNIFICATION
By using the App, you agree to defend, indemnify, and hold harmless the Developer, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees) arising from or related to: (a) your use of or access to the App; (b) your violation of this Privacy Policy or any applicable law or regulation; or (c) your violation of any third-party rights.
15. DISPUTE RESOLUTION AND GOVERNING LAW
This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any dispute arising out of or in connection with this Policy or the App shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, the dispute shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration authority in that jurisdiction, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Where mandatory local law gives you the right to bring proceedings in the courts of your country of residence, or otherwise prohibits the arbitration provision above, that law prevails over this section.
16. SEVERABILITY
If any provision of this Privacy Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of this Policy, and this Policy shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein.
17. ENTIRE AGREEMENT
This Privacy Policy, together with the Terms of Service, constitutes the entire agreement between you and the Developer regarding the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
18. CHANGES TO THIS PRIVACY POLICY
We reserve the right to update, modify, or replace this Privacy Policy at any time at our sole discretion. If we make material changes, we will update the "Last Updated" date at the top of this Policy. Your continued use of the App after any such changes constitutes your acceptance of the revised Privacy Policy. It is your responsibility to review this Policy periodically for changes.
The introduction of advertising in version 1.3 is such a material change, which is why this Policy describes it plainly, describes it before that version ships, and states exactly which versions it applies to.
If any future version of the App introduces analytics, additional advertising or mediation partners, banner or interstitial advertising, online accounts, or any other new data collection, we will name it in this Policy and update it before that version ships, and, where required by law, obtain your consent prior to collecting any personal data.
